June 2010 - Atrium Owners Legal Update
After a lengthy wait, the Court in the Netherlands Antilles has issued a decision in the lawsuit that was filed against Mr. Rowie Percoco (and others). We are thrilled with this decision and we are confident that it will benefit the Atrium Resort as well as its owners.
Please note that Festiva and the Atrium were not contesting the legal validity of the Atrium leases/contracts. Rather, we were only questioning the use of the CPI as an accurate measure for maintenance fee increases and the ability to charge special assessments when absolutely necessary because the leases/contracts are silent on this point.
Here are a few brief important highlights from the decision:
- Based upon ‘reasonableness and fairness’, the court supplemented the leases and allowed the 2007 10% maintenance fee increase and the special contribution of twice the annual maintenance fee.
- The current agreement (lease) covers annual maintenance contributions, but does not govern non-recurrent extra contributions that may be needed in extraordinary circumstances (such as special assessments for necessary updates at the resort).
- Percoco’s counterclaims were dismissed.
- Percoco and others were ordered to pay the amounts due from 2007, increased by legal interest beginning December 3, 2007.

Lots of exciting things are happening at the Atrium this summer! We are happy to announce that Miguel’s Spa & Salon is officially open for business. The restaurant formerly known as Picante has made some changes and is now called the Green House. It is serving dinner only. There is also a new breakfast service bar in the lobby called Café Crème. It serves gourmet coffee and other beverages along with upscale pastries. We’re certain you will be thrilled with these new amenities and services on your next visit to St. Maarten and the Atrium!
